1. Definitions

Some special terms used in these Terms are defined as follows:

Contract: These Terms of Service include all policies, rules and guidelines published on the Website from time to time.

Advertising Content: Any content and files you publish on Facebook, TikTok or Google through the Services.

Membership: Subscription system that provides the ability to publish and manage advertisements through the Marpany platform.

Trial Period: Trial membership that provides 7 days of free usage, including paid user rights.

User: The person or business benefiting from Marpany services.

Services: All web-based analysis, automation and advertising management features offered by Marpany.

2. Use of Services

Marpany services do not target individuals under 18 years of age and do not collect personal data from this age group. Access to the Services is granted through a limited, non-transferable and revocable license for personal and commercial use.

User agrees to use the services only on behalf of their own business. Access for the purpose of creating competing products, copying content or software is not permitted. You are responsible for your username and password; sharing with third parties is prohibited.

Marpany commits to protecting user brand and reputation and avoiding harmful behavior.

3. Pricing

Marpany membership fees are published at www.marpany.com/pricing. The stated prices do not include taxes and fees. A valid credit card is required during membership registration.

Marpany reserves the right to change prices based on increases in service costs. Past payments are non-refundable in case of membership cancellation.

Your membership automatically becomes paid at the end of the trial period; if you wish to cancel, you must close your account before the trial period ends.

Payments for Facebook, Google or TikTok ads are made directly to these platforms.

4. Disclaimer and Limitations

Marpany is merely a technical advertising management application. You are solely responsible for the content of the advertisements you publish. Marpany is not obligated to pre-review advertising content; however, it reserves the right to reject or delete content submitted through the service.

Marpany does not guarantee that the services will always operate uninterrupted, error-free or fully meet expectations. Liability for direct or indirect damages arising from the use of the services is limited.

Marpany's total liability is limited to the total amount collected from you in the last 12 months or $100 USD.

Legal liability arising from incomplete or incorrect information provided by the user lies with the user. However, if Marpany makes incorrect postings despite correct information, the responsibility lies with Marpany.

5. Intellectual Property Rights

All content, design, software and brands on the Website belong to Marpany or relevant third parties. Unauthorized use, copying, distribution and sale of this content is prohibited.

For advertising content uploaded by the user, an unlimited, transferable and perpetual right of use is granted to Marpany.

6. Data Collection and Processing

To use the services, you need to share your name, email address and other personal information. Marpany may process this information for service provision and information purposes. Personal data may be used to provide user-specific recommendations and advertisements. You can stop receiving email communications at any time.

• Content you create while using the Marpany platform

Automatically Collected Information

• Device information such as IP address, browser type, operating system
• Time spent on our website, pages viewed and links clicked

7. External Links

The Website may contain links to Facebook, TikTok, Google and other third-party platforms. Marpany is not responsible for the content of these sites. These links are for convenience and do not imply any recommendation.

8. Relationship Between Parties

Under these terms, no employer-employee, partnership or agency relationship is established between the user and Marpany.

The parties undertake not to make statements that damage each other's commercial reputation in public forums, including social media. Otherwise, a penalty of 50,000 TL applies.

9. Indemnification

The user agrees to indemnify Marpany against any damages and costs arising from violation of these terms, advertising content infringing third-party rights, or illegal use.

10. Termination

The user may cancel their account at any time during the trial period. For paid membership cancellation, written notice is required at least 15 days before the end of each month. Otherwise, the membership fee for the next month will be charged.

If Marpany detects use contrary to the terms by the user, it reserves the right to terminate the service and delete data without prior notice.

The parties acknowledge in advance that no fee will be charged during the trial period and that if dissatisfied, the user will not share their experience on any social media or complaint platform.

11. Operation of Services

Marpany has the right to stop, modify or limit all or part of the services. It has no liability to the user for these changes.

12. Changes to Terms

Marpany may update these terms at any time. Changes will be published on the website and notified to the user via email. Users who do not accept the changes may terminate their membership. Continued use of the services means acceptance of the changes.

13. Assignment

Marpany may transfer its rights and obligations under this agreement to its group companies.

14. Severability

If any provision of the Terms is deemed invalid, the remaining provisions shall remain in effect.

15. Enforcement and Jurisdiction

These Terms of Service are subject to the laws of the Republic of Turkey and Istanbul Central Courts and Enforcement Offices have jurisdiction in any disputes that may arise.
